IMPORTANT SAFETY NOTICE: NavCard GPS products are for VFR reference use only. They are not approved for IFR operations. Pilots are solely responsible for verifying all navigation information against current official sources before any flight. Do not use NavCard GPS data as your sole source of navigation information.
1. Acceptance of Terms
By accessing navcardgps.com, creating an account, or purchasing any NavCard GPS product or subscription, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
2. Products and Services
NavCard GPS offers navigation database subscriptions and hardware products for use with Garmin GNS 430 and GNS 530 series avionics. Our products include:
- NavCard GPS data cards (physical hardware)
- NavCard GPS USB programmer hardware
- Navigation database subscriptions (annual, quarterly, or per-cycle)
- Software tools for writing navigation data to NavCard GPS data cards
3. Subscriptions and Billing
Subscription Plans: Annual and quarterly subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
Cancellation: You may cancel your subscription at any time through your account dashboard or by emailing [email protected]. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time on active subscription periods.
Per-Cycle Purchases: Single-cycle purchases are non-refundable once the data has been downloaded or written to a card.
Price Changes: We will provide at least 30 days' notice before changing subscription prices. Continued use after the effective date constitutes acceptance of the new price.
Payment Processing: All payments are processed by Stripe, Inc. By providing payment information, you authorize NavCard GPS to charge the applicable fees.
4. Hardware Warranty
NavCard GPS data cards and USB programmer hardware are warranted against manufacturing defects for 60 days from the date of delivery. This warranty covers:
- Physical card defects (cracking, connector failure) not caused by misuse
- Failure to read or write data under normal operating conditions
- USB programmer hardware defects
This warranty does not cover damage caused by misuse, modification, or use with incompatible hardware. To make a warranty claim, email [email protected] with your order number and a description of the issue. Approved warranty claims will be fulfilled with a replacement product at no charge.
5. Returns and Refunds
Hardware: Unopened hardware may be returned within 30 days of delivery for a full refund. Opened hardware is eligible for return only under the warranty terms above.
Subscriptions: Annual subscriptions may be refunded within 14 days of purchase if no data has been downloaded. After 14 days or after first use, subscriptions are non-refundable.
Pre-orders: Pre-order deposits are fully refundable until the product ships.
6. Acceptable Use
You agree not to:
- Share subscription credentials or data downloads with others
- Reverse engineer, decompile, or disassemble NavCard GPS software
- Use NavCard GPS data for commercial redistribution
- Attempt to circumvent subscription or access controls
- Use the service in any way that violates applicable law
7. Aviation Safety Disclaimer
NavCard GPS navigation data is derived from FAA NASR public domain data. It is provided for VFR reference use only and is not approved for IFR navigation.
NavCard GPS is not affiliated with, endorsed by, or sponsored by Garmin Ltd. Garmin, GNS 430, GNS 530, and related product names are trademarks of Garmin Ltd.
Pilots are solely responsible for verifying all navigation information against current official sources (current sectional charts, NOTAMs, and official government publications) before any flight. NavCard GPS makes no warranty regarding the accuracy, completeness, or currency of navigation data for any specific flight operation.
Use of NavCard GPS products does not relieve the pilot-in-command of any responsibility under 14 CFR Part 91 or any other applicable regulation.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVCARD GPS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS OR SERVICES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, OR AVIATION INCIDENTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Merrimack County, New Hampshire.
10. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. For material changes, we will notify you by email if you have an account with us. Continued use after the effective date constitutes acceptance.
